This Indenture, Made the sixteenth day of March in the year of our Lord One thousand eight hundred and One, Between Shimeaz Harmon of Canaan, County of Columbia and State of New York of the first part and Jesse Goodrich of the said Canaan, County and State aforesaid of the second part, Witnesseth that the said party of the first part for and in consideration of the Sum of One Hundred & Fifty Pounds, lawful money of the State of New York to him in hand, at or before the ensealing and delivery of these presents, by the said party of the second part, the receipt whereof is hereby confessed and acknowledged, Hath granted, bargained, sold aliened, remised released, conveyed assured, {word} and confirmed, And by these presents doth grant, bargain, sell, alien, remise, release, assure, {word} and confirm, fully, freely and absolutely, unto the said party of the second part, and to his heirs and assigns forever, All that certain piece of Land lying and being in the said Canaan aforesaid, being the West part of the farm that I now live on, bounded and described as followeth, to wit, beginning on the Highway that leads by Ovid Drakes to Green River Meeting House where Ovid Drakes line crosses the said highway on the West side of said Highway, from thence North on said Highway to the land of Thomas Barret, thence Westerly adjoining said Thomas Barrets land to lands owned by Elijah Barret, still continuing westerly, adjoining said Elijah Barrets land, to lands owned by Ezra Parks thence Southerly abutting the lands of said Ezra Parks and Smith Parks to land owned by the said Ovid Drake, thence easterly abutting said Drakes land to the first mentioned Bounds, containing by estimation Thirty Acres, be the same more or less - - - Together with all and singular the appurtenances, privileges and advantages whatsoever, unto the said above mentioned and described premises, in any wise appertaining or belonging, and the reversion, and reversions, remainder and remainders, rents issues and profits thereof; And also all that Estate, right title, interest, property, claim and demand whatsoever, as well in law as in equity, of the said party of the first part of, in, and to the same, or any part or parcel thereof, with the appurtenances. To Have and to Hold, the above granted, bargained and described premises, with the appurtenances unto the said party of the second part his heirs and assigns for their own proper use, benefit and behoof forever. And the said party of the first part, for himself, his heirs executors and administrators, Doth covenant, promise and agree to and with the said party of the second part, his heirs and assigns, That he the said party of the first part, at the time of ensealing and delivery of these presents, is lawfully seized in his own right, of, in and to the aforesaid described premises, hereby granted and conveyed, with the appurtenances as of a good, {word}, perfect, absolute and indefeasible estate of inheritance in the law, in fee simple, without any manner of condition to alter, change, determine or defeat the same; and have in him good right, full power and lawful authority to grant, bargain, sell convey and release the above said described land and premises, with the appurtenances, unto the said party of the second part, his heirs and assigns, in manner aforesaid; And also that he the said party of the second part, his heirs and assigns, shall and may, from time to time, and at all times, and forever hereafter peaceably and quietly have, hold, occupy, possess and enjoy the said hereby granted and bargained premises, with the appurtenances: And also that the said party of the first part and his heirs and all and every other person or persons whomsoever lawfully or equitably deriving any estate, right, title, Dower, {word}, or interest of, in or to the herein before granted premises, by from, under or in trust for him and them, shall and will, at any time and times hereafter, upon reasonable request of the said party of the second part, his heirs or assigns, and at the proper costs and charges, in the law, of the said party of the second part, his heirs or assigns, make do and execute, or cause or procure to be made, done and executed, all and every such further and other lawful and reasonable conveyance and assurance in the law, for the better and more effectually vesting and confirming the premises hereby intended to be granted, in and to the said party of the second part, his heirs and assigns forever, as by the said party of the second part his or their council, learned in the law, shall be reasonably devised, advised or required. — And the said party of the first part for himself, his heirs executors and administrators, engage to Warrant, and by these presents forever to defend the above described and released premises, and every part and parcel thereof. Personally came before me Jacob Ford, First Judge of the Court of Common Pleas, within and for the County of Columbia, John Powell, who being duly Sworn, Deposeth{?} and saith that he saw Shimaaz Harmon Sign Seal and deliver the within Indenture, as his voluntary Act and Deed for the uses and purposes therein mentioned, and that the same time he this deponent, together with Elijah Wells, subscribed their names as witnesses to the Execution thereof, and further says that he knew the said Shimaaz Harmon and knows him to be the person who executed the same (the said Deponent is a person to me well known) which evidence is to me satisfactory. — I having examined the said Indentures, do not find any material Interlination or reasures, do allow the same to be Recorded

1802-02-11 New Concord Meeting House Trustees Elected

We the subscribers hereunto, hereby certify that at the Meeting House commonly called New Concord meeting house in the Town of Chatham County of Columbia and State of New York near the dwelling Houses of Capt. Ebinezer {sic} Cady and Hosea Beebie {sic} Esquires where divine worship had for Many Years been and stil{e?} is {?}atedly attended, the Congregation was publickly {sic} notified by Seth Jenne, Deacon of the Church usually worshipping at said Meeting House (for want of a Minister) on the twenty four day of January in the year of our Lord One thousand and eight hundred and two, that an Election of Trustees would be held on the eleventh Day of February then next ensuing at said Meeting house to the intent that religious Society should there be incorporated Agreeable to an Act of the Legislature of the State of New York to provide for the incorporation of Religious Societies Passed the 27th March 1801 And that said notice was given as aforesaid for two successive Sabbaths on which said Congregation met at the Meeting house aforesaid. and that pursuant to said notices a meeting was held on said eleventh day of February at said Meeting house and then and there William Babcock, Abel Eaton Anson Pratt, Daniel Smith, Joseph Doty, and Benjamin Toby were duly elected Trustees. Agreeable to said Act, by a plurality of Voices, and that during said Election said Seth Jenne, Deacon, together with Benjamin Hurlbert who was nominated returning Officer, by a majority of the Members present presided and received the Votes of the Electors said Trustees and their Successors shall forever hereafter be called and known by the name and title of The Trustees of the Society of New Concord.

  2. William Babcock - 6 Jun 1776 - 11 Jul 1812. Stone reads: "In, memory of, WILLIAM BABCOCK, ?? died, July 11 1812, aged, 36 years". Born: 6 Jun 1776, Chatham, Columbia County, NY, USA. [There are links to several other family members graves: of particular interest a daughter, Lucretia C. Babcock b. 15 Mar 1806 Chatham and a son, Justus Avery Babcock b. 8 Feb 1808 Chatham; both died in Ohio. No mention of a wife. jhc] [2]

Born: 19 Mar 1747, Stonington, New London County, Connecticut, USA. Husband of Lucretia Davis Babcock, father of William Babcock.   6. Mary Allen - Unknown - 4 Aug 1834. Stone reads: " MARY, daughter of, William & Sally Allen died, Aug 4 1834, aged 10 years". [No further info.] [The Beers 1873 Columbia County Atlas shows what I know as the Cash place across the bridge as "W. Allen". This burial ground must have served as a community burial ground.] [6]

  7. Jesse Goodrich - 17 Apr 1787 - 14 Sep 1837. Stone reads: "JESSE GOODRICH, DIED, Sept 14 1837, [??] yrs". Born: 17 Apr 1787, Canaan, Columbia County, NY, USA. [No further info. This is Jesse Goodrich Jr. jhc] [7]

  8. Lucy Powell Goodrich - Unknown - 28 Jul 1865. Stone reads: "LUCY, Wife of, Jesse Goodrich, DIED, July 28 1865, AGED 76 YEARS". [No further info. She was born in 1789. Wife of Jesse Goodrich Jr. jhc] [8]

More About Capt William Avery Babcock

"Info from: C Bohn

"Deacon Daniel Babcock, grandfather of the writer, referring to his brother Capt William Avery Babcock, April 5, 1845, said, "William served in the Revolutionary Army, and was engaged in the capture of Burgoyne." Joshua Babcock, a nephew of Capt William, said that he was Ensign in the Revolutionary War and later Captain on Militia.

"In April, 1777, a party of 11 Householders" apparently from Columbia Co, commanded by Capt Martin Beebe, rode to Albany, "to do all in their power for the defense of America in general and New York State in particular, fearing lest timely assistance for the defense of the city and stores should fail." They arrived on the 17th inst. Their bill, which covered only their expenses, was sent to the committee asking for L6 18s. Among the eleven persons were "Sergt. Wm. Babcock" and his wife's father, "Lieut. John Davis." (NY in the Revolution, Supplement, p. 139.)

"On p. 203 of the same book is a list of persons who received Land Bounty Rights for services or willingness to serve in defense of the frontiers of the State. The name of William Babcock is found in this list.

"Capt William Avery Babcock was a farmer and owned much land. He was the boss carpenter at the building of the Spencertown Presbyterian Church, which is still standing. New Lebanon, NY, records state that he was elected Assessor for the years 1787, '88, '90, '92, and Fence Viewer for the year 1791. Babcock Genealogy p. 108-9"

Notes From My Visit to the Burial Ground

On 2023-07-03 I stopped to have a look at the cemetery to see if there was a stone for Ebenezer Cady, and one for Nathiel Northrup, a fellow I have not been able to identify.

On my visit to the cemetery I found the 6 stones shown in the photo of the burial ground at Find-a-Grave but no stone for Ebenezer Cady nor one for Nathiel Northrup.

[1] Ebenezer Cady - I found the 6 stones shown in the photo at Find-a-Grave. A stone for Ebenezer Cady was not among them.

[2] William Babcock - This stone was is broken with the top piece tumbled down the bank. I leaned the piece up against a tree.

[3] Lucretia Davis Babcock - I found this stone lying on the ground as shown at Find-a-Grave.

[4] Nathaniel Northrup - I found no stone for Nathiel Northrup. Find-a-Grave shows a photo of Capt. Babcock's stone with Northrup's listing. The stone is largely covered with lichen and mostly unreadable but I doubt he would be memorialized on the same stone with Capt. Babcock, especially since he died 7 months before Babcock. All the existing stones are accounted for. I suspect this grave is listed in error at Find-a-Grave.

The Last Will and Testament of John Clerk of the Town of Chatham in the County of Columbia deceased.

In the Name of God Amen, I John Clerk of the Town of Chatham County of Columbia and State of New York being well as to bodily health and of sound mind and memory blessed be Almighty God for the Same, [viewing?] the uncertainty of human life the certainty of Death and the uncertainty when - do make and publish this my last Will and Testament in the manner & form following, that is to say, Firstly I give and bequeath my Soul to God that gave it, with hope of a certain resurrection to everlasting life. NOTE: This appears to me to be a deed to what I know as the Willard Doyle farm, later Jack Doyle's place, at the top of the hill in Piersonville. This deed was recorded in 1830 in Liber O, Page 427, immediately preceding the deed to Ebenezer Cady 1823-06-03 Deed - William A. Babcock to Ebenezer Cady. Both were recorded after William A. Babcock's death in 1829. jhc

This Indenture made the second day of April in the year one thousand eight hundred and forty nine Between Charles L Thomas & Cornelia L. his wife of the Town of Chatham County of Columbia & State of New York of the first part and Lorenzo J Goodrich of the Town County & State aforesaid of the second part, Witnesseth That the said parties of the first part in consideration of the sum of Two Thousand Eight hundred and fifty dollars lawful money of the United States, to them duly paid have sold and by these presents do grant & convey to the said party of the second part All of one equal undivided moiety or half part of All that certain piece parcel lot of farm of land situated lying & being in the Town of Chatham aforesaid lying on both sides of the highway leading from Cyrus L Ford's to Elijah Birge, Bounded on the North or Northerly by lands of William K and Arnold K White, on the East or Easterly by lands of Cyrus L Ford of Talcott C Starks and lands of John T Shufelt, on the South or Southerly by lands of Asa Be[??] and on the West or Westerly by lands of Elijah Birge, The whole farm containing by estimation one hundred acres of land be the same more or less. This is the three acre parcel with tenement house mentioned in several deeds settling the William G. Stewart's estate. Was this the place now owned by the Sawyer's. I remember as a kid Gladys Bemiss, a Goodrich relative, living there with her kids. jhc

All that certain piece, parcel or lot of land lying and being in the aforesaid Town of Chatham, bounded, situated and described as follows viz: bounded on the North by lands of William D. Steward\[sic\], on the East by the highway leading from the house of William Allen to the house of Henry Willetts and on the South and West by lands of Henry Willetts. containing three acres one rood and some rods of land be the same more or less. In the Name of God, Amen I Betsey Stewart the widow of William D. Stewart, deceased, residing in the town of Chatham in the County of Columbia and state of New York, being of sound and disposing mind, memory and understanding, and mindful of the uncertainty of this life, do make, publish and declare my last Will and Testament as follows, to wit: First After the payment of all my debts, funeral and administration expenses, I give and bequeath unto my beloved son, William G. Stewart, the use and enjoyment of the whole income arising from my whole estate, so long as he shall live and no longer. Second After the decease of my said son William G. Stewart, then I give and bequeath the whole of the said income of my said estate to my beloved brother Lorenzo J Goodrich, should he said Lorenzo, then be living but should my said brother Lorenzo then be dead then I give, devise and bequeath all my property then remaining unto the heirs at law of said Lorenzo J Goodrich, in the same manner as to distribution thereof among his said heirs, as if said Lorenzo had died without a will intestate. Third And I do further direct and order that my whole estate during the life of both said William G. Stewart and said Lorenzo J Goodrich, shall be held in trust by my executors hereinafter named, to take and hold the whole of my estate and pay over to William G. Stewart and said Lorenzo J. Goodrich the income of said the state as is hereinbefore provided and directed. And lastly, I do hereby appoint my said brother Lorenzo, J, Goodrich and Frederick C. Goodrich his son to be the executors of this my Will and the trustees under the same, giving them or the survivor of them, full power, and authority to sell, and dispose of any or all the real estate of which I may die seized, should they or the survivor of them see proper and best so to do, and I do hereby revoke all former Wills by me made. This Referee's deed conveys the 120 acre Cyprian Powell farm in Red Rock to William G. Stewart upon foreclosure of a mortgage to William D. Stewart inherited by his son, William G. Stewart

This Indenture, made this 27th day of July in the year of our Lord one thousand eight hundred and ninety two Between Sanford W. Smith referee in the action hereinafter mentioned of the first part, and William G. Stewart of the Town of Chatham, Columbia County N. Y. of the second part, Whereas, At a term of the Columbia County Court held at the Chamber of the County Judge in the City of Hudson on the 4th day of June one thousand eight hundred and ninety two it was among other things, ordered, adjudged, and decreed by the said Court in a certain action then pending in the said Court, between William G. Stewart as sole surviving executor of the last will and testament of William D. Stewart, deceased, against Louisa Powell and Louise Spencer, that all and singular the premises described in a mortgage executed by Cyprian Powell and Louisa Powell his wife of the town of Austerlitz in the County of Columbia, N. Y. to William D. Stewart of the Town of Chatham in said County & State and recorded in Columbia County Clerk's Office in Liber 47 page 262 and being the same premises mentioned in the complaint in said action, and in said judgment described, or so much thereof as might be sufficient to raise the amount due to the plaintiff for principle, interest and costs in said action, and which might be sold separately without material injury to the parties interested, be sold at public auction, according to the course and practice of said Court, by or under the direction of the said Sanford W. Smith (who was appointed a Referee in said action, and to who it was referred by the said order and judgment of the said Court, among other things, to make such sale; that the sale be made in the County where the said mortgaged premises, or the greater part thereof, are situated; that the said Referee give public notice of time and place of such for sale, according to the course and practice said Court, and that any of the parties in said action might become a purchaser or purchaser on such sale; that the said Referee execute to the purchaser or purchasers of the said mortgaged premises, or such part or parts thereof, as shall be sold, and a good and sufficient deed or deeds of conveyance for the same. And whereas the Referee, in pursuance of the order and judgment of the said Court did, on the 23rd day of July one thousand eight hundred and ninety two sell at public auction, at the law offices of H. W. and G. McClellan, in the town of Chatham Columbia County N. Y. the premises in the said order and judgment mentioned, due notice of the time and place of such sale being first given, agreeably to the said order; at which sale the premises hereinafter described were struck off to the said party of the second part for the sum of Three Hundred Dollars that being the highest sum bidden for the same. Now this indenture witnesseth, that the said Referee the party of the first part these presents, in order to carry into effect the sale so made by him as aforesaid, in pursuance of the order and judgment of the said Court, and in conformity to the statute in such case made and provided, and also in consideration of the premises and the sum of money so hidden as aforesaid, having been first duly paid by the said party of the second part, the receipt whereof is hereby acknowledged, hath bargained and sold, and by these presents doth grant and convey to the said part of the second part, All the right title and interest which Louisa Powell and Louise Spencer had on the 12th day of May 1892, they being the only heirs at law and next of kin of Cyprian Powell deceased, as mortgagor of and to the following described premises All that certain piece, parcel or farm of land, situate lying and being in the town of Canaan, in the County of Columbia and State of New York, bounded generally as follows; On the north by Addison Burrows and lands in possession of M. Kendell and Zenos Burrows, and Rual Ford and Amos S. Goodrich; west by Amos S. Goodrich, Rhoda B. Starks, Leban Holdridge, and Arnold Holdridge; on the south by John Phillips and Henry Webster and the east by said Henry Webster, Addison Burrows and others, containing about one hundred and twenty acres, more or less, and being the farm now in the possession of the party of the first part hereto (Cyprian Powell and Louisa Powell his wife) To have and to hold all and singular, the premises above mentioned and described, and hereby conveyed unto the said party of the second part his heirs and assigns forever. This Indenture, made this 29th day of March, in the year of our Lord one thousand eight hundred and ninety four, between Sarah C. Currie of Rutland, Vermont, party of the first part, and John Howes of Red Rock, Columbia County, New York, party of the second part, Witnesseth, that the said party of the first part, in consideration of the sum of Four Hundred Dollars, (less unpaid taxes, $63.82 = #336.18), to her duly paid, hath sold, and by these presents doth grant and convey to the party off the second part, his heirs and assigns, All that certain triangular shaped tract or farm of land, situate lying and being in the Town of Austerlitz, in the County of Columbia and State of New York, bounded and described generally as follows, viz: northerly by lands of James Finning, the Richmond Ironworks, and Ezekiah Barrett, respectively, east by lands of Frederick Farrand and lands of Reed Howes: south and southerly by lands of said Reed Howes, and lands of Garrett Van Valkenburgh, containing two hundred and seventy acres of land, more or less. Being the same premises conveyed to the said Garrett Van Valkenburgh by deed from Cornelius Hardick and Maria, his wife, dated February 25th 1865, and recorded in Columbia County Clerk's office in Liber No. 22 of Deeds page 400. With the appurtenances, and all the estate, title and interest therein of the said party of the first part. And the said party of the first part doth hereby covenant and agree to and with the said party of the second part, his heirs and assigns, that the premises thus conveyed in the quiet and peaceable possession of the party of the second part, his heirs and assigns, she will forever warrant and defend against any person whomsoever lawfully claiming the same, or any part thereof.

NOTICE TO CREDITORS.—-Pursuant to the order of Hon. Isaac N. Collier, Surrogate of the County of Columbia, notice is hereby given, according to law, to all persons having claims against William G. Stewart, late of the town of Chatham, in the County of Columbia, deceased, they are required to present the same with vouchers thereof to the subscribers, Administrators of said deceased, at the law offices of McClellan & Dardess at Chatham, N. 1895-01-30 William Stewart Farm Sale

Sale of Real Estate

On Monday morning occurred the sale, at the law office of McClallans & Dardess, of four parcels of real estate to settle the estate of the late William Stewart who resided near Red Rock. The parcels consisted of the homestead which sold for $4500, the Cyprian Powell farm which brought $1100, a tenement house on the home farm $150, a six acre piece of land known as the Thomas Roach wood lot $50, a total of $5800. Lorenzo J. Goodrich purchased all. $5800 for these parcels seem a very low price, quality of land and buildings considered.
