APPENDIX E - Stewart Farm to Frederick C. Goodrich

This is a collection of documents leading to Frederick C. Goodrich's acquisition of title to the William and Betsey Stewart farm.

Frederick C. Goodrich and William G. Stewart were first cousins and next door neighbors. It's likely that Frederick C. stepped in to help his cousin out on the farm when William G. went crazy and was commited to a mental institution at Poughkeepsie NY. The animals have to be fed and the cows milked. I think it likely he then continued to run the farm after William died and shortly after bargained with the Stewart estate to acquire the farm.

It became a rather convoluted process which commenced almost immediately after William G.'s death, beginning with quit-claim deeds from other members of the Stewart family, and was finally completed in 1899 with a quit-claim deed from his father, Lorenzo, and brother, Jesse.

The Properties

The following deeds all involve three or four of these four Stewart properties.

From Betsey Stewart's Estate

First - The main home farm of approximately 198 acres. This farm was inherited by Betsey and Lorenzo Goodrich from their father, Jesse Goodrich Jr. Betsey was married to William D. Stewart. There is no deed from Jesse's estate to the Stewarts.

Second - A wood lot of about 5 acres north of the home farm on the west side of the highway between the home farm and Colbert's farm toward New Concord. This property was acquired by William D. Stewart from Joseph D. Clark by deed recorded April 17th, 1869.

From William G. Stewart's Estate

Third - About three acres and tenement house on the west side of the highway abutting the south boundary of the home farm. This property was acquired by William G. Stewart from Albert Griswold by deed dated July 31st 1856 and recorded October 27th 1856 in the Columbia County Clerk's Office in Book 5 of Deeds at page 602.

Fourth - The former Cyprian Powell farm in Red Rock, approximately 120 acres, this property was acquired by William G. Stewart at a referee's sale by deed recorded August 1st, 1892.

The Chain of Title

Gathered here are Betsey Stewart's Last Will and Testament and subsequent deeds relating to Frederick C. Goodrich's acquisition of the home farm after William and Betsey Stewart's son, William G. Stewart, died on April 5th, 1894.

1) 1891 - Lorenzo J. and Frederick C. Goodrich, Named Trustees of Betsey Stewart's Estate

On the death of Betsey Stewart on October 10th, 1891, her brother, Lorenzo, and Lorenzo's son Frederick C. Goodrich become executors andtrustees of Betsey's estate, to be held in benefit of her son William G. Stewart for the remainder of his life, and authorized "to sell and dispose of any or all the real estate of which I may die seized" after William G. dies. William G. Stewart died April 5th, 1894.

2) 1894 - William G. Stewart Dies

After William G. Stewart dies, the trustees of Betsey Stewart's estate are authorized to sell Betsey's properties.

George McClellan and Jesse D. Goodrich, son of Frederick C. Goodrich, are appointed administrators of William G. Stewart's estate.

3) 1894 - Stewart Family Deeds to Frederick C. Goodrich

We start with a collection of deeds, all recorded on July 5th, 1894, three months to the day after William G. died. The first three are quit-claim deeds from Stewart family relatives of William D. Stewart and William G. Stewart to Frederick C. Goodrich.

Also recorded on July 5, 1894 is a previously un-recorded deed dated March 14, 1849 from Lorenzo J. Goodrich to William D. Stewart for his 1/2 interest in the main farm he and his sister Betsey inherited from their father's estate.

4) 1895 - Lorenzo J. Goodrich Purchases the Properties at a Referee's Sale

What was this about? It seems Frederick C. Goodrich brought an action against several parties, including his father Lorenzo and the administrators of William G. Stewart's estate, among others, relating to settling the Stewart estates affairs.

This action resulted in the public sale of the four properties. Lorenzo bought them all and then transferred all but the Cyprian Powell farm in Red Rock to his sons, Jesse D. and Frederick C. Goodrich. The three deeds were recorded together on November 18, 1895.

5) 1899 - Lorenzo and Jesse D. Quit-claim to Frederick C. Goodrich

Finally, Lorenzo J. and Jesse D. quit-claim their interest in the farm to Frederick C. Goodrich. I assume this includes the Lorenzo's exception and Jesse's interest deriving from the above deed from Lorenzo J. Goodrich to Jesse D. and Frederick C.Goodrich.

Betsey Stewart's Last Will and Testament Transcribed

Betsey's Last Will and Testament is dated October 1st, 1891; she died on the 10th. Below is the record of probate dated October 30th 1893 and recorded the following day.

Record of the last will and testament of Betsey Stewart late of the town of Chatham Columbia County N.Y. deceased as a Will valid to pass real and personal property, together with the proofs relating thereto, taken in the Surrogate's Court of the County of Columbia, N.Y. and the decree admitting same Will to probate.

In the Name of God, Amen I Betsey Stewart the widow of William D. Stewart, deceased, residing in the town of Chatham in the County of Columbia and state of New York, being of sound and disposing mind, memory and understanding, and mindful of the uncertainty of this life, do make, publish and declare my last Will and Testament as follows, to wit: First After the payment of all my debts, funeral and administration expenses, I give and bequeath unto my beloved son, William G. Stewart, the use and enjoyment of the whole income arising from my whole estate, so long as he shall live and no longer. Second After the decease of my said son William G. Stewart, then I give and bequeath the whole of the said income of my said estate to my beloved brother Lorenzo J Goodrich, should he said Lorenzo, then be living but should my said brother Lorenzo then be dead then I give, devise and bequeath all my property then remaining unto the heirs at law of said Lorenzo J Goodrich, in the same manner as to distribution thereof among his said heirs, as if said Lorenzo had died without a will intestate. Third And I do further direct and order that my whole estate during the life of both said William G. Stewart and said Lorenzo J. Goodrich, shall be held in trust by my executors hereinafter named, to take and hold the whole of my estate and pay over to William G. Stewart and said Lorenzo J. Goodrich the income of said estate as is hereinbefore provided and directed. And lastly, I do hereby appoint my said brother Lorenzo J. Goodrich and Frederick C. Goodrich his son to be the executors of this my Will and the trustees under the same, giving them or the survivor of them, full power and authority to sell and dispose of any or all the real estate of which I may die seized, should they or the survivor of them see proper and best so to do, and I do hereby revoke all former Wills by me made. In Witness Whereof, I have hereto set my hand and seal this 1st day of October 1891.

Columbia County. s.s: John P. S. Gifford of the Town of Chatham and George McClellan of the town of Ghent in the County of Columbia being first duly sworn in open court, on their oaths do depose and say that they are subscribing witnesses to the instrument now shown to them, purporting to be the Last Will and Testament of Betsey Stewart of the Town of Chatham, in the County of Columbia aforsaid, deceased, and bearing date on the 1st day of October in the year of our Lord, one thousand eight hundred and ninety-one. That the deponents signed their names as witnesses to said instrument at the request and in the presence of the said Betsey Stewart and in the presence of each other. That the deponents saw the said Betsey Stewart execute the said instrument and heard her declare the same to be her last Will and Testament at which time the said Betsey Stewart was upwards of 21 years of age and of sound mind and memory, and not under restraint to the knowledge or belief of these deponents. That said Betsey Stewart is now dead, and was at the time of her death an inhabitant of the Town of Chatham in the County of Columbia and State of New York.

Goodrich, the executors and trustees named in said Will and on filing due proof of service of citation on the only next of kin and only heir at law of said deceased and on all persons interested under any of the provisions of said Will and Special guardian having been appointed and appearing for the said heir at law and next of kin, a lunatic, and after hearing the proofs, and it appearing that said Will was duly executed; that the testatrix was at the time of making said Will in all respects competent to make the same, and was not under any restraint. It is Ordered and Decreed That said Will bearing the date October 1st 1891 be and the same hereby is admitted to probate as a Will valid to pass real and personal property and that the same with the proofs relating thereto be recorded accordingly; the probate of said Will not having been contested; Ordered further that Letters Testamentary thereof issue to said executors and trustees they having taken and filed the oath prescribed by law.

2) 1895 - Lorenzo J. Goodrich Purchases the Properties at a Referee's Sale

Sale of Real Estate

On Monday morning occurred the sale, at the law office of McClellans & Dardess, of four parcels of real estate to settle the estate of the late William Stewart who resided near Red Rock. The parcels consisted of the homestead which sold for $4500, the Cyprian Powell farm which brought $1100, a tenement house on the home farm $150, a six acre piece of land known as the Thomas Roach wood lot $50, a total of $5800. Lorenzo J. Goodrich purchased all. $5800 for these parcels seem a very low price, quality of land and buildings considered.

This Indenture Made this eleventh day of May in the year one thousand eight hundred and ninety five Between Aaron Gardenier Referee in the action hereinafter mentioned, of the first part, and Lorenzo J. Goodrich of the town of Chatham, County of Columbia, and State of New York of the second part: Whereas at a special Term of the Supreme Court of the State of New York held at the City of Hudson on the eighth day of December one thousand eight hundred and ninety four, it was, among other things, ordered, adjudged and decreed, by the said court, in a certain action then pending in the said Court, between Frederick C. Goodrich, Plaintiff, and Lorenzo J. Goodrich and Laura Ann Goodrich his wife, Mary A. Dayton, Lena Shaw, Valdia May Couch, Hazel Ellen Couch, Rena Crosby Couch, Alanson Burrows, Lucy Petit, Ida F. Goodrich and George McClellan and Jesse D. Goodrich as Administrators of [etc?] of William G. Stewart, deceased, Defendants. That all and singular the premises mentioned in the complaint in said action, and hereinafter described, be sold at Public Auction, according to the course and practice of said Court, by or under the direction of the said Aaron B. Gardenier who was appointed a Referee in said action, and to whom it was referred by the said order and judgement of the said Court, among other things to make such sale; that the said sale be made in the county where the said premises, or the greater part whereof, are situated; that the Referee give public notice of the time and place of such sale, according to law and the rules and practice of said Court, and that any of the parties in the said Action might become a purchaser or purchasers on such sale; that the said Referee, after said sale, make report thereof to said Court, and after his report of sale shall have been duly confirmed, then that he execute to the purchaser or purchasers, of the said premises, or such part or parts thereof as should be so sold, a good and sufficient deed or deeds of conveyance for the same. And Whereas the said Referee, in pursuance of the order and judgement of the said Court, did, on the twenty eighth day of January, one thousand eight hundred and ninety five sell at Public Auction at the law offices of McClellans & Dardess, in the village & town of Chatham, in the County of Columbia NY the premises in the said order and judgement mentioned, due notice of the time and place of such sale being first given, agreeably to the said order; at which sale the premises hereinafter described were struck off to the party of the second part, for the sums of One Hundred and Fifty Dollars for the first parcel hereinafter described and Eleven Hundred Dollars for the second parcel hereinafter described, being the highest sums bidden for the same respectively, and the said Referee's report of said sale having been duly confirmed by the Court directing the said Referee to execute the proper conveyance pursuant to the sale, and also directing concerning the application of the proceeds of the sale. This Indenture Made this eleventh day of May in the year one thousand eight hundred and ninety five Between Aaron Gardenier Referee in the action hereinafter mentioned, of the first part, and Lorenzo J. Goodrich of the town of Chatham, County of Columbia, and State of New York of the second part: Whereas at a special Term of the Supreme Court of the State of New York held at the City of Hudson on the eighth day of December one thousand eight hundred and ninety four, it was, among other things, ordered, adjudged and decreed, by the said court, in a certain action then pending in the said Court, between Frederick C. Goodrich, Plaintiff, and Lorenzo J. Goodrich and Laura Ann Goodrich his wife, Mary A. Dayton, Lena Shaw, Valdia May Couch, Hazel Ellen Couch, Rena Crosby Couch, Thomas Roach, Ida F. Goodrich and Lorenzo J. Goodrich and Frederick C. Goodrich as administrator with the Will annexed of William D. Stewart, deceased and Lorenzo J. Goodrich and Frederick C. Goodrich as Executors of the last Will and Testament of Betsey Stewart, deceased, and George McClellan and Jesse D. Goodrich as Administrators of [?] of of [sic] William G. Stewart, deceased, Defendants. That all and singular the premises mentioned in the complaint in said action, and hereinafter described, be sold at Public Auction, according to the course and practice of said Court, by or under the direction of the said Aaron B. Gardenier who was appointed a Referee in said action, and to whom it was referred by the said order and judgement of the said Court, among other things to make such sale; that the said sale be made in the County where the said premises, or the greater part thereof, are situated; that the Referee give public notice of the time and place of such sale, according to law and the rules and practice of said Court, and that any of the parties in the said Action might become a purchaser or purchasers on such sale; that the said Referee, after said sale, make report thereof to said Court, and after his report of sale shall have been duly confirmed, then that he executed to the purchaser or purchasers, of the said premises, or such part or parts thereof as should be so sold, a good and sufficient deed or deeds of conveyance for the same. And Whereas the said Referee, in pursuance of the order and judgement of the said Court, did, on the twenty eighth day of January, one thousand eight hundred and ninety five sell at Public Auction at the law offices of McClellans & Dardess, in the Village & town of Chatham, in the County of Columbia NY the premises in the said order and judgement mentioned, due notice of the time and place of such sale being first given, agreeably to the said order; at which sale the premises hereinafter described were struck off to the party of the second part, for the sums of Four Thousand and Five Hundred Dollars for the first parcel hereinafter described and Fifty dollars for the second parcel hereinafter described, being the highest sums bidden for the same respectively, and the said Referee's report of said sale having been duly confirmed by the Court directing the said Referee to execute the proper conveyances pursuant to the sale, and also directing concerning the application of the proceeds of the sale. [Now?], this Indenture Witnesseth That the said Referee, the party of the first part to these presents, in order to carry into effect the sale so made by him as aforesaid, in pursuance of the order and judgment of said Court, and in conformity to the statute in such case made and provided, and also in consideration of the premises, and of the said sum of money so bidden as aforesaid, being first duly paid by the said party of the second part, the receipt whereof is hereby acknowledged. Hath bargained and sold, and by these presents, doth grant and convey, unto the party of the second part. All the right, title and interest of all the parties to the above action of, in and to the two following described parcels of land. First, All that certain piece, parcel or farm of land, situated lying and being in the town of Chatham aforesaid, lying on both sides of the highway leading from the Village of Chatham to Red Rock, bounded on the south or southerly by lands of William G. Stewart, deceased, Mrs. John Harmon, wood lot occupied by Steine & Boice, and the wood lot of Lorenzo J. Goodrich, on the west or westerly by lands of said Frederick C. Goodrich, on the north or northerly by lands of Lawrence Colbert and lands occupied by John B. Lamoree; on the east or easterly by lands of said Lamoree, and lands of Alexander Bartlett and Mrs. Sylvester Garner. The whole containing by estimation one hundred and ninety eight acres of land be the same more or less. Second All that certain piece, parcel or lot of wood land situate, lying and being in the town of Chatham, County of Columbia and State of New York, bounded and described as follows, viz. Bounded on the north by lands of Lawrence Colbert; on the east by the highway leading from New Concord to the house of William D. Stewart, on the south and west by lands of John Hogan, containing five acres, two roods and fifteen rods of land by survey. To have and to hold all and singular the premises above mentioned and described, and hereby conveyed or intended so to be, unto the said party of the second part, his heirs and assigns, to them their only proper use, benefit and behoof forever. And Witness Whereof The party of the first part, Referee as aforesaid, hath hereunto set his hand and seal, the day and year first above written.

This Indenture Made the ninth day of October in the year eighteen hundred and ninety five Between Lorenzo J. Goodrich and Laura Ann Goodrich his wife of the town of Chatham County of Columbia State of New York of the first part and Jesse D. Goodrich and Frederick C. Goodrich of the same place of the second part. Witnesseth. That the said parties of the first part in consideration of the sum of One Dollar lawful money of the United States paid by the parties of the second part do hereby grant and release unto the said parties of the second part, their heirs and assigns Forever, with the exception and reservation hereinafter noted, all the Following described three parcels of land lying and being in the town of Chatham, County of Columbia and State of New York bounded, situated and described as follows: viz: Bounded on the North by lands of William D. Steward[sic] (deceased), on the east by the highway leading from the house of William Allen to the house of Henry Willetts, and on the south and west by lands of Henry Willetts containing three acres, one rood and [some?] rods of land, be the same more or less. This Indenture, Made this first day of March in the year of our Lord one thousand and eight hundred and ninety nine. Between Jesse D. Goodrich and Adelaide Goodrich, his wife, and Lorenzo J. Goodrich, all of the town of Chatham, county of Columbia, State of New York. parties of the first part, and Frederick C. Goodrich, of the town of Chatham, county of Columbia, State of New York, party of the second part. Witnesseth, That the said party of the first part, in consideration of the sum of Twenty Five Hundred Dollars, to them in hand paid by the said party of the second part, the receipt whereof is hereby confessed and acknowledged, have bargained, sold, remised and Quit Claimed , and By these Presents do bargain, sell, remise and Quit-Claim unto the said party of the second part, and his heirs and assigns forever, the following three parcels of land: First, All that Tract, Piece or Parcel of Land, situate in the town of Chatham, county of Columbia and State of New York. Goodrich hereby covenants that he has not encumbered said premises and that as to his undivided on half thereof he will forever warrant and defend the same. Together with all and singular the hereditaments and appurtenances thereto belonging or in anywise appertaining and the reversion and reversions, remainder and remainders, rents, issues and profits thereof, and all the estate right, title, interest, claim and demand whatsoever, of the said parties of the first part, either in law or equity, of, in or to the above bargained premises, with the said hereditaments and appurtenances To Have and To Hold the said described lands and premises to the said party of the second part, his heirs and assigns, to the sole and only proper benefit and behoof the said party of the second part, his heirs and assigns forever.
