1768-03-08 Quit Claim, Jacobus' 1/3 of Farm, by Andries B. Huyck and Dirck Huyck to Elizabeth Huyck & Sons

Burger Huyck, in his will, left the farm to his wife, Mayche, during her remaining life and thence to their three sons, Andries, Dirck, and Jacobus. After Mayche and Jacobus died, Andries and Dirck hereby release any claim they may have to Jacobus' 1/3 interest in the farm to Elizabeth, Jacobus' widow.

This Indenture made the Eighth Day of March in the Year of our Lord one thousand Seven hundred and Sixty eight Between Andries B. Huyck and Dirck Huyck The two Surviving Sons of Burger Huyck late of Kline Kill in the County of Albany Farmer deceased of the one part and Elizabeth Huyck Widow of Jacobus Huyck and Aaron Huyck and Burger Huyck two of the Children of the said Jacobus Huyck of the other part. Whereas the Said Burger Huyck in his life Time was Seized in fee of and in a certain dwelling House Barn Farm and Plantation Situate at Pomponack in the County aforesaid and an Interest in a patent granted to himself Peter Van Allen Lambert Huyck and others in Comp'{sic?} And Also in the Generall Patent of Kinderhook and a Considerable personal Estate in being so Seized and possessed of the Said real and personal Estate on the twenty fifth Day of April 1759 - made his last Will and Testament duly executed and among other things Devised as follows I give unto my three Sons Andreas Jacobus and Dirck Huyck my Whole Estate real and personal on the Conditions therein mentioned after his Wife Mayche deceased and after the making of the Said Will the Said Burger died Seized of the Real and Personal Estate and Whereas the said Mayche his Widow and his son Jacobus are also both Since deceased Whereby the Said Andries & Dirck are both intitled to the Lands and Tenements premises and personal Estate {Joint?} tenancy and they not willing to take any Advantages of the Widow and Children their deceased Brother Jacobus Witnesseth that the Said Andries and Dirk Huyck for the Consideration aforesaid and for Divers other Good Causes and Considerations and for and in Consideration of the Sum of ten Shillings Current Money of New York to them by the Said Elizabeth Aaron and Burger Huyck in Hand paid at and before the ensealing & delivery of these Presents The receipt whereof they do hereby acknowledge and thereof and of every part and parcell thereof do acquit Release and Discharge them the Said Elizabeth Aaron and Burger their Heirs and Assigns for ever by these presents have granted Bargained Sold alienated enpossed{sic?} Remised Released and Confirmed and by these Presents do Grant Bargain Sell alien {something?} release and Confirm unto the Said Elizabeth Aaron and Burger the one third Part of the aforesaid dwelling House Farm Land premises and personal Estate. Together with the one third part of all and Singular Buildings Improvements Woods Underwood profits Commoditys Heriditaments and appertenances whatsoever unto the aforesaid Dwelling House Farm parcells of Land Premises and

Personal Estate belonging or in anywise appertaining or therewith Used Occupied or enjoyed and the Reversion and Reversions Remainder and Remainders thereof and also all the Estate, right, Title, Interest, Property, possession, Claim and Demand whatsoever of them the said Andries Huyck and Dirck Huyck and each of them of and in and to the said one third part of the Said Dwelling House Farm parcells of Land premises and personal Estate with the appurtenances aforesaid To have and to hold the Said one third part of the said Dwelling House Farm or plantation and parcells of Land and premises and personal Estate with the appurtenances herein before mentioned and intended to be hereby granted and released and every part and parcell thereof unto the Said Elizabeth to the only proper Use and Behoof of the Said Elizabeth During her natural Life and Widowhood and after her decease or marriage the said one third of the real Estate to the Said Aaron and Burger their Heirs & Assigns for ever they or their heirs paying to each of their Sisters namely Mayche & Hillitje the sum of Forty Pounds and the Remaining personal Estate to be Equally divided among the Said Aaron Burger Mayche and Hillitje. In Witness whereof the Party's to these Presents have hereunto Interchangeably Set their, hands & Seals the Day & Year first above Written Sealed and Delivered } in the Presence of us} John Schrom{sig} Johannis Huyck{sig}
