Know all men by these presents that I Dirck Huyck of Kinderhook in the County of Albany and Province of New York Yeoman, are Held and firmly Bound unto Elizabeth Huyck the Mother of Arent and Burger Huyck Devisees of the Last will and Testament of Andries B. Huyck of the County of Albany Deceased in the sum of One Hundred Sixty pounds Current money of the Providence of New York To be paid unto the Said Elizabeth Huyck or to her Certain Attorney heirs Executors Administrators and Assigns. To the which payment well and Truly to be made and done I bind myself my heirs Executors and Administrators And Every of them Firmly by these presents Sealed with my Seal and Dated this Twenty ninth day of January in the year of Our Lord One Thousand Seven Hundred and Seventy Two and in the fourth year of his Majesty's Reign.
Whereas the Said Andries B Huyck by his Last will and Testament duly Executed Bearing date the Sixth day of February One thousand Seven Hundred and Seventy did Amongst Other Things therein Contained Give and Bequeath unto Burger Huyck the Sum of Sixty pounds Current Lawful money of New York unto Batie Huyck and Moyaca Huyck Each the Sum of Ten Pounds Son and Daughters of the Above Boundon Dirck Huyck To be paid by Arent and Burger Huyck the devisees to the Real Estate of the Said Testator And Whereas the said Elizabeth Huyck has at the Request of the Above Bounden Dirck Huyck the father on the day of the date hereof paid until they Said Dirck Huyck the father the Said Legacies of Eighty pounds for the use and benefit of the Said Burger Huyck Batie Huyck and Moyaca Huyck Son and Daughters - - - - Who are in their Minority and under the age Twenty One years Now the Condition of the Above Obligation is Such that if the said Dirk Huyck the father his Executors Administrators or Assigns Shall pay the Said Legacys of Eighty Pounds - - - - to the Said Burger Huyck, Batie & Moyaca Huyck Son and Daughters - - - - When they Shall Attain the age of Twenty One Years, or if the Executors And Administrators of the said Burger Huyck, Batie and Moyaca Huyck Son and Daughters - - - - Next after the Attainment of their age of Twenty One years or if the Executors or Administrators of the said Burger Huyck Batie & Moyaca Huyck upon their Decease before the Attainment of the Said age Shall Execute And Deliver unto or to the use of the Said Elizabeth or the Devisees Before Named their Executors And Administrators a Sufficient Release and Discharge of and from the Said Eighty pounds - - - - Legaceys so paid as aforesaid and all Actions Suits and Demands in Law and Equity Concerning the Same And Also if they said Dirck Huyck the father his heirs Executors And Administrators do and Shall at all Times hereafter well and Sufficiently Indemnify and Save harmless the Said Elizabeth Huyck And Also the Said Arent and Burger Huyck the Devisees Above mentioned their Several and Respective heirs and Assigns Lands Tenements Goods and Chattles of and from all actions Suits Damages and Demands Whatsoever for About or Concerning the Said Legaceys in Any wise then this Obligation to be Void and of no Effect Otherwise to be and Remain in full force and Virtue - - - -

Same date as BH027 ~ 1772-01-29 Release of Liability by Andries Claw to Elizabeth Huyck Regarding Andries B. Huyck's Estate.
Notes:
This is the signed and sealed version of the legal arrangement that the earlier unsigned draft (BH035) was attempting to establish. Dated January 29, 1772, it resolves the complicated estate obligations from Andries’s will with elegant clarity.
What Andries’s will required:
- £60 to Burger Huyck son of Dirck
- £10 each to Batie Huyck and Moyaca Huyck — Dirck’s daughters, new names in the archive
- Total: £80 to Dirck’s three children
What actually happened:
Elizabeth, at Dirck’s request, paid the £80 directly to Dirck on January 29, 1772 — advancing the money on behalf of Arent and Burger Huyck as devisees. Since Dirck’s three children were all minors and couldn’t receive the money themselves, Dirck took it as their father and guardian.
Dirck’s obligations in return:
- Pay the £80 to his children Burger, Batie, and Moyaca when each reaches age 21
- Or if any child dies before 21, their executors must release Elizabeth and the devisees from the legacy
- Indemnify Elizabeth, Arent, and Burger Huyck against any future claims arising from this payment

The £160 bond — Dirck bound himself for £160, double the £80 actually paid, as a penalty bond — standard legal practice to ensure compliance. If he failed to pay his children or indemnify Elizabeth, he owed double.

Elizabeth advanced enormous sums — over £330 in estate payments in just over a year — while simultaneously managing the farm, the shop, the children’s education, and her own household. The financial pressure this placed on her is now fully visible.
